Our Privacy Policy governs the manner in which Newtrade Media collects, uses, maintains and discloses information collected from users of betterretailing.com, betterwholesaling.com and newtrade.co.uk websites. This privacy policy applies to all sites and all products and services offered by Newtrade Media.

  1. Definitions

“Newtrade Media“, “we“, “us“, “our” means Newtrade Media Limited, a company incorporated in England (registration number 09338494) and with our registered office at 11 Angel Gate City Road, London, EC1V 2SD.

“Websites” means any website operated by Newtrade Media Ltd.

“Services” means any product or other service that is operated by Newtrade Media Ltd.

“Visitors” means any individual that visits our Websites, but that we can’t identify yet.

“Users” means any Visitor of our Websites that has provided us with identifiable information (e.g., by filling a form on a landing page).

“Subscribers“, “Customers” means any individual who has an account or has engaged with any of Newtrade Media’s Services in exchange of money.

“Data Protection Laws” means all applicable laws in relation to (a) data protection; (b) privacy; (c) interception and monitoring of communications; (d) restrictions on or requirements relating to the Processing of Personal Data of any kind, including the General Data Protection Regulation ((EU) 2016/679) )”the GDPR”), the Data Protection Act 2018 and all other  laws addressing identity theft or security breach.

Beside these specific definitions we will use the meanings as defined in the GDPR regulation.

2.1. Information you provide to us

a) Through our Websites

In some specific cases you provide data to us through our Websites. For example, you may provide your contact details when you when you opt-in for our newsletters, register to one of our competitions, leave a comment on the Websites or when you fill out a contact form.

b) Through our Services

We sometimes need to collect personal data when you use our Services. For example, you provide us with information when you subscribe to our print titles RN, Retail Express and Better Wholesaling, when you sign-up to a premium account on Better Retailing, benchmark your store with the IAA, when you book advertising in our products, take part in a Newtrade Media event (like the Local Shop Summit, Independent Achievers Academy and the Better Wholesaling Summit) or when you do an in-store project with us and a supplier partner.

c) Information you provide through direct communication

When you communicate directly with a member of our team (e.g. a member of our sales team) you provide us with your contact and business information. You may also provide our reporters with information when they call you or email you in regards to a story for journalistic purposes.

2.2. Information we collect automatically

a) Cookies and other tracking technologies

Cookies are small pieces of text sent by your web browser by a website you visit. A cookie file is stored in your web browser and allows the Websites or a third-party to recognise you and make your next visit easier and the Websites more useful to you.

We use cookies and other tracking technologies in order to provide our Services, give you a better website experience and to improve our Websites and Services. In our cookie policy you can get more information and see the list of cookies/integrations/tags that we have implemented within our Services. This includes the use of third-party analytics services like Google Analytics.

b) Information on how you use our Services

When you visit and interact with our Websites we collect certain information in the background in order to optimise and improve the Services going forward. This includes for example things like device and connection information, log data, logins, page views, API calls (Application Programming Interface), usage of specific features and error logging.

In some of our processes we make use of public information that we can find about you, for example via LinkedIn or similar services where you provide your information publicly with intention.

We may receive information about you through other third-party partners, such as suppliers, symbol groups and franchises we work with in order to deliver our Services.

3.1. Fulfilment of our Websites

We use information you delivered to us in order to provide our Websites, including customer support, log files, rendering fonts and to operate and maintain the Websites. We also use your data in order to personalise your experience according to your user preferences.

3.2. Fulfilment of our Services

a) Responding to your enquiries

When you contact a member of our team to enquire about our Product and Services we use your data as required specifically to fulfil that purpose.

b) Fulfilling your requests and delivery of a Service

For example when you:

  • Subscribe to a magazine, we use your contact, billing and delivery details to process your application.
  • Register to attend an event, we use your contact, billing and delivery details to process your application. If you are making a group booking, please ensure you have permission from others to share their name and contact details with us. We might share the delegate list, attendee list, table plan and/or screen presentation ahead of some events – please email us if you would prefer your name not to appear.
  • Register to access online content we use your contact/billing details and user preferences to administer your account.
  • Apply for a job, we use your contact details and work history as provided to process your application.
  • Enter a prize draw or competition, we use the contact and delivery details provided in order to fulfil the service.
  • Benchmark with the IAA, we use you contact details and data provided throughout the process to create reports for those taking part, to process your submission and to decide who will be recognised. Summaries of this data may be used, for example the average shop size taking part, or in how we explain who has been recognised and why.

3.3. Communicating with you about our Services

Our aim is not to be intrusive, and we undertake not to ask irrelevant or unnecessary questions. We sometimes need to contact you directly in order to send you specific service or transactional communications about a product or service, with the purpose of fulfilling the Service requirements or improving your experience of the product or Service with useful notifications.

3.4. Marketing and promoting our Services

a) When will we market to you?

We use your data in order to send promotional information to you that may be of specific interest to you. Our goal is to make the information as meaningful as possible for you.

We will only send you direct marketing communications when you have either provided your consent (e.g. ticked a box or clicked a “button” to submit a form) or where we believe we can demonstrate a legitimate business interest and have balanced this with your interests and privacy.

It is always your choice and you can stop receiving direct marketing communications from us at any time. We will provide a clear and easy way to do this on any communication you receive. For electronic marketing communications (via email, sms and phone) we adhere to the rules of the Privacy and Electronic Communications Regulations (PECR).

b) Email newsletters

We produce editorial newsletters for several brands. You will receive regular newsletters from the bulletins you have signed up to.  You can manage your subscription to these emails through your profile page when you are signed in to your  account. You can decide not to receive these emails at any time and will be able to “unsubscribe” directly by clicking a link in the email.

c) Marketing automation

We use marketing automation tools and website tracking in order to increase lead quality and assess the likeliness that you might be interested in our services, to ensure marketing communications remain relevant.

3.5. Personalised experience

We want to ensure that your customer experience is more relevant to you. As part of our promise to help retailers work smarter, not harder, we offer a personalised experience in some our Websites. This includes using the data provided in your user preferences to personalise your news feed (you can change your interests at any time) and using your business information to send you updates and marketing communications that are of interest to you.

3.6. Safety and security

We use information about you to increase the safety and security of our Websites and Services. For example for verifying your account, detecting fraudulent activities and anything else that would make our Services more secure.

3.7. Cookies and other tracking technologies

We use cookies to store information and identify you across our various web properties. For example, to identify you in our Services or to track your activity in order to improve the Websites and Services. You can find the full list of cookies in our cookie policy. We also use cookies to gather information on user behaviour with a view to improve the Websites and Services.

We use remarketing and retargeting technologies in order to promote our Services to you in a personalised way. For example, we use Google Analytics/Google Adwords to build remarketing lists and Facebook ads technology (including the Facebook pixel and custom audiences) to show you ads on other platforms and re-engage you with our Websites and Services.

  1. The lawful bases we rely on

Under the GDPR there are six lawful bases under which organisations can collect, use and store personal data. We have identified four which we rely upon for our business activities: Consent, Contractual, Legitimate Interests and Legal Obligation.

Contractual – in many circumstances we rely on the lawful basis of “performance of a contract”, this enables us to get back to you when you express an interest in our Websites and Services and to fulfil any requests.

Consent – in some circumstances we rely on your specific consent, whenever you actively agree and “opt-in”. We will always make it clear how you can withdraw you consent at any time.

Legal Obligation – there will be circumstances under which we are legally obliged to hold your personal data or required to disclose it to a third party by law.

Legitimate Interests – for some of our activities we rely on our legitimate business interests to collect and use your personal data. In such cases, we have balanced our interests with yours and do not believe these activities will have a negative impact on your privacy rights and freedoms. We specifically rely on Legitimate Interests to:

  • manage specific aspects of our events

  • send you marketing communications related to other companies’ products and services (in a business-to-business context).

  1. How we share information we collect

We work with third-party service providers for various tasks within our organisation, including billing, subscription fulfilment, marketing, customer support, analysis, accounting and others. If we transfer your personal data to a service provider in order to fulfil a task, we will make sure that the service provider only processes the data based on our instructions and by guaranteeing the same safeguards as we do. On top of that we guarantee that we have signed a data processing agreement with every service provider that makes sure that the partner is bound to the strict rules under the Data Protection Laws.

5.1. Sharing information to fulfil a service

We sometimes need to share information with partner companies as part of the delivery of a Service (like the Retail Express competition or when you require a rep visit from our Category Management section). Any data transfer in this regard is guaranteed to be in line with the Data Protection Laws.

We may share information under this Policy in the case of any merger, sale, financing or acquisition of a part or the whole of any Newtrade Media business. We will notify you accordingly in case this situation should arise.

The following third parties will receive your personal data for the following purpose(s) as part of the processing activities involved in the delivery of subscription Services:

  • Seymour Distribution Ltd – distributors of print title RN
  • Beeline Distribution Ltd – distributors of print title Better Wholesaling
  • Inter-media Ltd – subscription management and distributors of print title RN
  • News Printers Ltd – printers and distributors of print title Retail Express
  • Southern Printers Ltd – printers of print titles RN and Better Wholesaling
  • Advantage Smollan Ltd – assessment partner for the Independent Achievers Academy

5.2. Law enforcement and compliance

We will share your information with a third-party (including law enforcement authorities) if:

  • We are required to do so by the requirements of any applicable law
  • In our good faith judgement, such action is reasonably necessary to comply with legal process
  • To respond to any legal claims or actions
  • To protect the rights of Newtrade Media, its customers and the public.

5.3. Non-personal information

In some cases we may share non-personal data, such as aggregated information, with third-parties, including for reporting obligations and business/marketing purposes.

6.1. How we secure your information

We use robust and state-of-the-art technical and organisational measures to secure the data that we have about you. For more details you can find our separate document on technical and organisational measures here. We are reviewing our data protection processes regularly in order to make sure that we protect your data in the best possible way. If we use sub-contractors and service providers to fulfil a specific task based on your data, we will make sure that the partner has similar state-of-the-art data protection processes in place.

6.2. How long we store your information

Newtrade Media will process and store personal data for 10 years as per Newtrade Media’s Data Protection Policy.

  1. Transmission of Data Overseas

7.1 In certain circumstances, we may transfer your personal information to countries outside the European Economic Area. This may include circumstances where we use service providers who are based outside the EEA or who use “cloud” infrastructure which means that their servers are based all over the world. Where we transfer your information to companies outside the EEA, we will make sure it’s protected in a manner that is consistent with how your information will be protected by us. This can be done in a number of different ways for instance:

  • The country that we send the information to might be approved by the European Commission.
  • The recipient company might have signed a contract obliging them to protect your information.
  • The recipient is located in the US and is a certified member of the EU-US Privacy Shield scheme.

7.2 In other circumstances the law may permit us to otherwise transfer your information outside the EEA. In all cases however, we will ensure that any transfer of your information is compliant with the Data Protection Laws.

Access, correction and deletion

8.1 Newtrade Media at your request, can confirm what information we hold about you and how it is processed. If Newtrade Media does hold personal data about you, you can request the following information:

  • Identity and the contact details of the person or organisation that has determined how and why to process your data. In some cases, this will be a representative in the EU.
  • Contact details of the data protection officer, where applicable.
  • The purpose of the processing as well as the legal basis for processing.
  • If the processing is based on the legitimate interests of Newtrade Media Ltd or a third party, information about those interests.
  • The categories of personal data collected, stored and processed.
  • Recipient(s) or categories of recipients that the data is/will be disclosed to.
  • If we intend to transfer the personal data to a country outside of EU or international organisation, information about how we ensure this is done securely. The EU has approved sending personal data to some countries because they meet a minimum standard of data protection. In other cases, we will ensure there are specific measures in place to secure your information.
  • How long the data will be stored.
  • Details of your rights to correct, erase, restrict or object to such processing.
  • Information about your right to withdraw consent at any time.
  • How to lodge a complaint with the supervisory authority.
  • Whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, as well as whether you are obliged to provide the personal data and the possible consequences of failing to provide such data.
  • The source of personal data if it wasn’t collected directly from you.
  • Any details and information of automated decision making, such as profiling, and any meaningful information about the logic involved, as well as the significance and expected consequences of such processing.

9.1 You have a number of legal rights in relation to the information that we hold about you, including:

  • Right to access: You have the right to request access to your personal data held by us. Requests are to be made in writing, electronically and information will be provided in a commonly used electronic format. Requests will be handled within one month of receipt of the request, and free of charge with the exception of where requests are manifestly unfounded or excessive we hold the right to charge a reasonable fee taking into account the administrative costs of providing the information.   • Right to rectification: You have the right to have personal data rectified if inaccurate or incomplete. Where the personal data in question has been disclosed to a third party, they will be made aware of the rectification where possible. Requests are to be made in writing, electronically, and will be handled within one month of receipt of the request.
  • Right to erasure: You have the right to request the deletion or removal of personal data in the following circumstances:
  • Where the personal data is no longer necessary in relation to the purpose for which it was originally collected/processed.
  • When you withdraw consent.
  • When you object to the processing and there is no overriding legitimate interest for continuing the processing.
  • The personal data was unlawfully processed (i.e. otherwise in breach of the GDPR).
  • The personal data has to be erased in order to comply with a legal obligation. This does not provide an absolute “Right to be forgotten”. Where the personal data in question has been disclosed to a third party, we will inform them about the erasure of the personal data, unless it is impossible or involves disproportionate effort to do so. Personal data will be erased by removal from our internal and cloud servers.
  • Right to restrict processing: You have a right to ‘block’ or suppress processing of personal data if you contest its accuracy; have objected to the processing; processing is unlawful and you oppose erasure; we no longer need the personal data but you require the data to establish, exercise or defend a legal claim. Where the personal data in question has been disclosed to a third party, we will inform them about the restriction on processing of the data, unless it is impossible or involves disproportionate effort to do so.
  • Right to data portability: You have the right to obtain and reuse your personal data for your own purposes. Requests are to be made in writing, electronically, and will be handled within one month of receipt of the request.
  • Right to object: You have the right to object to processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling); direct marketing (including profiling); and processing for purposes of scientific/historical research and statistics. You also have the right to make a complaint with the Information Commissioner at www.ico.org.uk if you think that any of your rights have been infringed by us.

10.1 Newtrade Media reserves the right to change this Privacy Policy. This privacy policy is held on our website or can be provided on request. We may update this policy from time to time and you may check to see if any changes have been made by referencing the date of the last update at the top of the policy.
